Mugabe gazettes CA19 Bill

PRESIDENT Robert Mugabe has gazetted Constitutional Amendment Number 19 Bill that gives legal effect to the formation of an all-inclusive Government in Zimbabwe.

Clause 15 of the Bill stipulates that the Executive shall consist of a President, two Vice-Presidents, Prime Minister, two deputy prime ministers, 31 ministers and 15 deputy ministers.

The Bill formalizes these posts and institutions that were created by the Global Political Agreement signed by President Mugabe and the oppositions leader Morgan Tsvangirai and Professor Arthur Mutambara on September 15.

In the deal – facilitated by the former South African President Thabo Mbeki – Tsvangirai  who heads the Movement for Democratic Change (MDC) would become the prime minister while President Mugabe retains his post. Prof. Mutambara, leader of the smaller faction of the MDC becomes deputy PM.

South African President Kgalema Motlanthe – who is the current chairman of the rotating chairmanship of Sadc - Saturday welcomed the amendment published in the official gazette.

In a statement Motlanthe said: "The gazetting of Amendment 19 of the Zimbabwean Constitution is indeed a major step towards the formation of an inclusive government in Zimbabwe."

He urged Zimbabwe's political parties "to establish an inclusive government as envisaged in the Global Agreement" and said South Africa and the Sadc "stand ready to assist the people of Zimbabwe as they embark on the difficult road towards the reconstruction and development of their country.

"We understand too well that this will indeed not be an easy task, however, with the support of Sadc, AU and the rest of the international community the Zimbabwean people will and must succeed," Motlanthe said.

Meanwhile, Justice Minister and Zanu PF chief negotiator in the power-sharing talks, Patrick Chinamasa was quoted by The Herald saying if the bill does not sail through, President Mugabe would call for fresh polls.

"I envisage that it will require two weeks for it to be debated and passed through both Houses. If no support is forthcoming, it means that Amendment Number 19 Bill will be dead matter," Chinamasa told the daily paper.
 
"In the event that the collaboration that we envisage is not forthcoming, then that will necessitate fresh harmonised elections at some point in time."

President Mugabe has also twice hinted at the possibility of fresh elections should the September power-sharing deal fail to get off the ground.

It is now unclear whether the MDC-T party will support the passage of the Bill.

The party was insisting that before the Bill is gazetted all outstanding power-sharing issues must be settled, i.e. the allocation of Ministerial posts [and therefore the composition of the Cabinet] in the proposed all-inclusive Government, the distribution of ambassadorial posts and provincial governorships, and the functions and composition of the National Security Council.

I think if the GNU fails. Then let's go back to elections. I personally think a constituency based Presidential election is better. The first past the post creates problems.

Look at Ghana. Atta Mills has one in more constituencies that Nana Akufo Ado. Yest now if the remaining constituency vote in favour of Ado Mills will loose despite being the most liked by voters.

I am appealing to our founding fathers to make sure they live with us a constitution that cannot be tempered with by the USD, or GBP, or EURO even if it means to do so by decree.

Similarly, I call upon Mr Tsvangirai to look at these issues with Zimbabwean eyes. We need his input. Look what happened when Gono and Chibebi talked, no more long lines at the bank because ZCTU suggestion was a good one. So what is Tsvangirai waiting for. Why not get on board and make good suggestions for Zimbabweans?

Guys (ZANU Pf and MDCs,) you have an an obligation.Come on lets see the ZIM fibre you guys are made of.

Like Tsvangirai, some of you are still hoping that he alone will be given the department of homeland affairs and not have it be chaired with ZANU-PF and MDC-M on a rotational basis. Well, those of you who are holding on to the imagination of Tsvangirai heading that department by himself needs to know that will never happen, Tsvangirai will ever be given unchecked police power out of the simple fact that he wants to use such power to overthrow President Mugabe and establish himself as Idi Amin, a dictator supported and facilitated by the West.

This time around it should work. This is the last opportunity presenting itself to the people of Zimbabwe and we should grab it. Let us form a government and not waste time on petty issues. Mugabe should realise that he caused the present breakdown by unilaterally grabbing important ministries and leaving the minor rest to the other parties. Whatever those who are blindly supporting Mugabe can say, that is not sharing. Sharing is about Equity. He who comes to Equity must come with clean hands. No more such occurances. Zimbabwe needs a government of National Unity without delay.

This talk of other issues like representation on security is all nonsense if not absolute rubbish. How can Chamisa claim there is no agreement on appointments of Ambassadors and secretaries and goes to say representation on security? Always contradicting himself as ever. According to the already signed documents which have been made public, Tsvangirai automatically sits on the security council by virtue of his post. So MDC is represented. Secretaries and Ambassadors will be posted after a deliberation between the President and the PM. So it's not one person to decide who will represent Zimbabwe in UK.

If you read through the gazetted Bill, it clearly states that all appointments will be made with consultation between the President and the Prime Minister and the PM shall be a member of the Security council. His party is a signatory to the Bill and they took part in crafting the Bill so what's the noise about?

Iri ndiro bundu reku musana chairo iri. Fellow Zimbabweans go through the gazetted Bill No,19. There is nothing zanu about it. Everything is clear. Even some of the already available documents, there is nothing sinister about them.More to that most of the items contained were from the MDC-T and the other part appears to have made lots of concessions for progress sake and yet Chamisa jumps runs all over like a headless chicken ,shouting Ndabirwa ndabirwa. Lets move forward.
