Zimbabwe Parliament passes CA19 Bill

ZIMBABWE'S House of Assembly has unanimously passed by acclamation Constitutional Amendment Number 19 Bill required to establish a legal framework which paves the way for the formation of the all-inclusive Government envisaged in the Global Political Agreement of Sept. 15, 2008.

Parliamentary Speaker Lovemore Moyo said 184 lawmakers in the 210-seat parliament attended today’s session which moved the Bill to the House floor for a quick vote.

The 184-0 vote in the Lower House easily surpasses the two-thirds majority needed to enact the legislation.

The Bill was the only item on Thursday’s Parliamentary Order Paper.

The Bill will now be taken to the Senate where it is expected to sail through without opposition before being assented to by President Mugabe. That vote is a formality expected later in the day.

The vote was greeted with jubilation and stomping of feet by legislators from both parties - a sign that things might be taking a different trajectory in Zimbabwean politics.

When he introduced the CA19 Bill, Justice Minister Patrick Chinamasa described the establishment of a unity government as "a leap of faith."

"It has been a long, frustrating, quarrelsome journey characterised by animosity and name-calling, but notwithstanding this, what is important is we have reached this path," said Chinamasa at the opening of the session.

MDC-T secretary-general Tendai Biti was less optimistic saying there was no choice. He said it was a "miracle" that the parties had managed to agree on the unity accord at all.

"Everything has happened on the negotiating table other than physical confrontation. It is a miracle that we are here," he said at the start of the session.

"We go into this government knowing that for this to work there has to be commitment," he said. "It is important to establish trust from the word go."

The opposition MDC-T formation's parliamentary chief whip Innocent Gonese had indicated Wednesday that the party would back the Bill "in line with the party's National Council resolutions."

Journalists who were in the public gallery said they had never seen such a rare show of unity between MDC and Zanu PF in the august House.

"The backwards and forwards discussions that took place and the facilitation efforts of (former South African President) Thabo Mbeki had 'enriched' the bill by garnering meaningful comment and insight," said a Zimbabwe Guardian reporter who was in the public gallery.

President Mugabe will remain Head of State while MDC-T leader Morgan Tsvangirai will become Prime Minister in the envisaged all-inclusive Government while faction leader Prof. Arthur Mutamabara of the other MDC formation will become Deputy Prime Minister.

The negotiating teams and the Principals will now proceed to the next step in the Sadc Timeline - the creation of posts of PM and Deputy PM.

February 11: Swearing in of Prime Minister and Deputy Prime Ministers by the President

February 13: Appointment of Ministers and Deputy Ministers (Cabinet)

There is no miracle here Biti. It will be a miracle if we do not hear you Biti complaining that Zanu PF is reneging on its agreement on when the distribution of provincial governors will be done. It will also be a miracle if charges against you are dropped or if the Zanu PF judges acquit you. It will be a miracle if you do not raise any further complaint throguh the media about the attitude of Zanu PF, as you have now legalised their future action. We no longer want to hear them, for everything is now irreversible. We just hope that after being swallowed, Zanu PF will fail to digest all of you.

The least that everyone with Zimbabwean interests at heart will do is to give this GNU a chance. Whatever is reported as having been said by anyone from any party is irrelevant at this point because the bill sailed through unopposed in both houses. The ideological party differences are clear for all to see and the passing of CA19 is a gesture worth applauding driven by our commonly shared national values. Needless to say that the GNU has a specific written down programme of events meant to deal with issues dividing us as a nation to allow for free and fair elections. As long as we continue to overemphasize the need to change personnel instead of systems, we are on a sure, tried and tested path of failure because a new system is more likely to yield lasting positive results than a new person. Hopefully our well represented decision making bodies will get down to the business of effecting the necessary changes to turn around our political culture as a nation. With support from all stakeholders the GNU presents us with an opportunity to chart a collective new route that will bring back trust, transparency and accountability in the Zimbabwean political systems. ALL the best Zimbabwe.

Alisdair Budd- This a historical day for Zimbabwe, SADC, African diplomacy, Thabo Mbeki, President Robert Mugabe and all those who participated in the process. Those who have exploited divisions amongst us and have rejoiced whilst Zimbabwe was burning will be bitterly disappointed. People like you Alisdair Budd appear to belong to this group. As far as Jestina Mukoko is concerned, let the law take its course. If she is innocent, she will be free and if she is not she has to face the consequences. The law should not be selective.

Congratulations Zimbabwe!!! This is the way it should be done. Above all I would like to convey my heartfelt gratitude to the Towering African Hero BABA THABO MBEKI for standing resolutely by Zimbabwe through these trying times and for engineering, directing and facilitating a truly Zimbabwean political settlement.

Baba Mbeki you have done Africa proud through your diplomacy par excellence and tact. Your effort today found its rightful place in the Zimbabwean constitution. What more could we as Zimbabweans ask for?

To President Mugabe, you were magnanimous in victory as evidenced by your willingness to accommodate the losing team into the corridors of power. You have done the unexpected and prevailed despite all the vilification by our detractors. Long live African Hero!!! You have done better than your teacher Dr Kwame Nkrumah who indeed should be smiling in his grave.

To the Prime Minister-designate, welcome aboard. We hope you will find wisdom and comfort in the corridors of governance. We remain grateful for your effort in single-handedly voting for RG Mugabe for the presidency by that' tactical' withdrawal from the race.

To fellow Zimbabweans, I congratulate you for your patience. These were indeed trying times. You proved that patience is indeed a virtue. I hope and pray that we shall never ever go down that path again.

This is a historic achievement. Let me take this opportunity to congratulate Zimbabweans from both sides of the political divide. You have shown the whole world that nothing is impossible in Zimbabwe.

Our political lives in Zimbabwe are defined by possibilities and choices including those that we blindly miss. Zvaitwa vana vevhu.

Lets all unite and rebuild our beloved country. Let us forgive each other for the past mistakes we made but let us not forget for we are bound to fall to the same trap as before.

To those who claim there are no choices, I beg to differ. There are plenty of choices in Zimbabwe. The only barrier that limits their realisation is the scope of human imagination or the lack of it.

Lets see if the MDC can get Justina Mukok released and all the others, and the charges dropped against Biti.

Otherwise the MDC is in the govt responsible for holding them, persecuting them and employing their torturers.

And proving they are nothing more than window dressing and are incapable of protecting their own members, let alone the people of Zim, from the real power in the land, the CIO.
